Welcome to STYL.LYST. These Terms of Service ("Terms") govern your use of the STYL.LYST mobile application (the "App") and the website styllyst.com (the "Site"), operated by STYL.LYST ("we," "our," or "us"). By creating an account or using our services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use STYL.LYST. By using the App, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3. Description of Service

STYL.LYST is a marketplace platform that connects clients seeking beauty and wellness services with independent service providers. We facilitate discovery, communication, and booking between users. STYL.LYST is not a party to any agreement between clients and providers and does not employ, endorse, or guarantee any provider.

4. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Harass, threaten, or abuse other users.
• Post false, misleading, or fraudulent content.
• Impersonate another person or entity.
• Attempt to gain unauthorized access to other users' accounts or our systems.
• Use the App to collect personal information about other users without their consent.
• Interfere with or disrupt the integrity or performance of the App.

5. Provider Terms

If you register as a provider on STYL.LYST:

• You represent that you hold all necessary licenses, certifications, and permits required to provide your services in your jurisdiction.
• You are responsible for the quality, safety, and legality of the services you offer.
• You agree to respond to client requests in a timely and professional manner.
• You acknowledge that STYL.LYST may charge service fees or commissions as described in the App.

6. Payments

Payments are processed through Stripe, our third-party payment processor. By using payment features, you agree to Stripe's terms of service. STYL.LYST facilitates payments between clients and providers but is not responsible for payment disputes between users. Providers receive payments according to the payout schedule described in the App, minus any applicable platform fees.

7. Cancellations and Refunds

Cancellation and refund policies are determined by individual providers and communicated at the time of booking. STYL.LYST may mediate disputes but is not obligated to issue refunds on behalf of providers.

8. Intellectual Property

The App, including its design, features, content, and branding, is owned by STYL.LYST and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without our written consent. Content you upload (photos, videos, text) remains yours, but you grant STYL.LYST a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the App to provide our services.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." STYL.LYST MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE APP'S RELIABILITY, AVAILABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY PROVIDERS ON THE PLATFORM.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STYL.LYST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO STYL.LYST IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless STYL.LYST, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third party's rights.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time by contacting us at support@styllyst.com. Upon termination, your right to use the App ceases immediately.

13. Modifications

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Texas.
